Terms of Service

Effective July 12, 2026

1. Agreement

By creating an account or using EstimateBy (estimatedby.com, the “Service”), you agree to these Terms. If you don't agree, don't use the Service.

2. What EstimateBy does

EstimateBy produces AI-assisted construction takeoffs and estimates from the plans you upload. Estimates are tools to assist your professional judgment — they are not guarantees of quantities, cost, or code compliance. You are responsible for reviewing every estimate before relying on it or sending it to a client.

3. Accounts

Provide accurate information, keep your login credentials secure, and take responsibility for activity under your account. Notify us of any unauthorized use.

4. Subscriptions & billing

Paid plans are billed through Stripe on a monthly or annual basis and renew automatically until canceled. Usage above your plan's included amount may incur overage charges shown at signup. You can cancel anytime in Settings → Billing; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable for partial periods.

5. Your content

You keep ownership of the plans, pricing, and other content you upload. You grant EstimateBy a limited license to store and process that content to provide the Service — including sending it to our AI provider to generate takeoffs. You confirm you have the right to upload and process the content you submit.

6. Acceptable use

Don't use the Service for anything illegal, don't upload content you don't have rights to, and don't attempt to disrupt, probe, or reverse-engineer the Service.

7. Marketplace

Project postings and bids in the marketplace are agreements between the posting party and the contractor. EstimateBy is not a party to those agreements and does not guarantee any job, bid, price, or outcome.

8. Availability

The Service is provided on an “as is” and “as available” basis. We work to keep it running reliably but do not guarantee uninterrupted or error-free operation.

9. Disclaimer & limitation of liability

To the maximum extent permitted by law, EstimateBy is not liable for indirect, incidental, or consequential damages, or for losses arising from estimating inaccuracies. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

10. Termination

We may suspend or terminate accounts that violate these Terms. You may cancel your account at any time.

11. Changes

We may update these Terms. Material changes will be posted here with a new effective date; continued use of the Service means you accept the updated Terms.
